Terms of Service

1. What GAMADS is

GAMADS is a managed ad creative generation platform. We produce ad copy, images, and audience research for the offers you run. You pay a fixed price per generation and we handle all underlying generation infrastructure on your behalf — you don't need to bring your own AI accounts.

2. Eligibility and acceptable use

You must be at least 18 years old and have the authority to bind the business or entity on whose behalf you're using GAMADS. You agree not to:

• Use GAMADS to produce ads that violate the advertising policies of the platforms you publish to (Meta, Google, TikTok, etc.).
• Scrape, reverse-engineer, or overload the GAMADS platform itself.
• Impersonate any person or misrepresent your affiliation with an organisation.
• Generate content that infringes third-party intellectual property, is defamatory, or is unlawful in your jurisdiction.

3. How payments work

You pay GAMADS for the service. We handle all underlying generation costs on your behalf — you don't manage or pay any other accounts to use GAMADS.

Generation pricing is a fixed amount per call, published in-app and charged at the moment a generation runs. The licenses, packs, and add-ons in Section 4 are separate one-time purchases that unlock features and offer slots, distinct from per-generation pricing.

4. What you can buy

4.1 Campaign License — €47, one-time

The Campaign License is the base purchase. It includes:

• Lifetime platform access. No subscription, no monthly fees, nothing to cancel.
• One offer slot. A slot locks one offer URL (e.g. yourdomain.com/offer1) to your account. See Section 4.6 for how slots work and how URL matching is done.
• 100 image generations pre-loaded into your wallet on day one (equivalent to €20 of wallet credit at the standard €0.20-per-image rate).
• Eligibility for the cheaper-leads guarantee for 14 days from purchase, per Section 8 and the Refund Policy.

4.2 Multi-Offer Toolkit — €37, at checkout only

An optional add-on offered alongside the Campaign License at the GAMADS checkout page. If purchased:

• 3 additional offer slots, lifetime (4 slots total when combined with the Campaign License's slot).
• Extends the cheaper-leads guarantee to 30 days from the Campaign License purchase date (double the standard 14-day window).
• Priority generation queue for image rendering.

The Multi-Offer Toolkit is sold only at the original checkout for €37. After checkout, equivalent slots can be purchased in-app as Extra Offer Slots (Section 4.5), but those do not extend the guarantee window.

4.3 Agency Pack — €197, post-purchase upgrade

The Agency Pack is a post-purchase upgrade offered on the thank-you page after Campaign License checkout. If purchased:

• 10 additional offer slots, lifetime. These stack on top of the Campaign License slot and any Multi-Offer Toolkit slots. A buyer who has purchased Campaign License + Multi-Offer Toolkit + Agency Pack therefore has 14 total offer slots (1 + 3 + 10). A buyer who skipped the Toolkit and went straight from Campaign License to Agency Pack has 11 total slots (1 + 10).
• +250 image generations loaded into your wallet at the moment of purchase (equivalent to €50 of wallet credit at the standard rate). Used generations are non-refundable per Section 4.4 and the Refund Policy.
• Bulk variant generation — generate images in bulk in a single batch instead of one at a time.
• Cheaper-leads guarantee — 30 days from the Agency Pack purchase date. This window resets on Agency Pack purchase regardless of the original Campaign License purchase date. A buyer who upgrades on Day 200 gets a fresh 30-day window starting Day 200. See Section 8 and the Refund Policy.

4.4 Wallet top-ups

The wallet is your prepaid balance for per-generation charges. Top-ups are available in three sizes:

Approximate generation counts assume the standard €0.20-per-image rate. Other models or higher resolutions consume more per call; the per-call price is shown in-app at generation time.

Wallet balance never expires.

Generations consumed are not refundable under any circumstance once executed. Each generation represents a real third-party API cost paid out on your behalf the moment it runs. This is true for:

• Generations consumed from your wallet top-up balance.
• The 100 generations bundled with the Campaign License.
• The 250 generations bundled with the Agency Pack.
• Any other promotional or admin-granted wallet credit, once consumed.

Unconsumed wallet balance from a Campaign License or Agency Pack refund follows the rules in the Refund Policy.

4.5 Extra Offer Slots — in-app, via Stripe

If you've already purchased the Campaign License and want more offer slots without (or after) taking the Multi-Offer Toolkit or Agency Pack:

Extra Offer Slot purchases are sold via Stripe from your Settings page or the in-app slot paywall. They are not the same product as the Multi-Offer Toolkit (Section 4.2) or the Agency Pack (Section 4.3): Extra Offer Slot purchases grant only the slots themselves. They do not include bundled wallet credit, do not reset or extend the cheaper-leads guarantee window, and are not refundable under the cheaper-leads guarantee. Statutory rights (EU consumer 14-day withdrawal, subject to the exceptions in that law) continue to apply.

4.6 Offer slots — how they work

An offer slot locks one offer URL to your account. Two rules to know up front:

What counts as the same URL. We normalize URLs before comparing them. Two URLs match if, after normalization, they're identical. Normalization rules:

• The hostname is lowercased (Example.com = example.com).
• The path is lowercased (/Offer1 = /offer1).
• The query string is stripped (/offer?utm=fb = /offer).
• The URL fragment is stripped (/offer#section = /offer).
• A trailing slash on the path is stripped (/offer/ = /offer).
• Subdomains count as distinct URLs. offers.brand.com and brand.com are different and require separate slots.

Slot reassignment. Each slot can be released and re-bound to a different URL once every 30 days, per slot. The cooldown clock is per-slot, not per-account. When you release a slot, it enters a 30-day cooldown before you can lock a new URL with it.

Slots are tied to your GAMADS account. They are non-transferable to other accounts and may not be resold.

5. Your content, your responsibility

Anything you generate through GAMADS is yours. You own the ad copy, the images, the research reports, the campaign data. You are solely responsible for reviewing, approving, and using any generated output. GAMADS is a tool; you are the advertiser.

6. No warranty on AI output

AI-generated content is probabilistic. It can be inaccurate, biased, or unsuitable for your use case. GAMADS provides the platform "as is" and "as available" without warranty of any kind regarding the accuracy, quality, or suitability of generated output. You must review every piece of output before publishing it or running it as an ad.

7. Intellectual property

The GAMADS platform — its code, design, branding, and infrastructure — is the intellectual property of Bulzay Solutions FZE. Your workspaces, prompts, assets, and generated outputs remain yours. You grant GAMADS a limited, non-exclusive licence to process your inputs solely to deliver the service to you.

8. Refunds — the cheaper-leads guarantee

GAMADS offers a performance-based, falsifiable refund mechanic called the cheaper-leads guarantee. The summary is below; the full mechanic, including required proof, edge cases, and the claim process, lives in the Refund Policy. The Refund Policy is incorporated into these Terms by reference.

Summary:

• If your post-purchase cost-per-lead on at least one offer is equal to or higher than your baseline cost-per-lead (the 30 calendar days immediately before purchase), we refund the eligible fees in full.
• The guarantee applies to the Campaign License fee (€47), the Multi-Offer Toolkit fee (€37, refunded alongside or after the Campaign License), and the Agency Pack fee (€197).
• Wallet generations are never refundable once executed, including the 100 generations bundled with the Campaign License and the 250 generations bundled with the Agency Pack.
• Extra Offer Slot purchases (Section 4.5) are not covered by the cheaper-leads guarantee. EU consumer statutory rights still apply where relevant.
• Refunds are processed via Stripe to your original payment method within 5–10 business days.

Statutory rights.EU consumers retain their 14-day right of withdrawal under EU consumer law (Directive 2011/83/EU), parallel to and independent of the cheaper-leads guarantee. The exceptions in that law apply — notably, once you've materially used the service (e.g. generated images, launched a campaign), the statutory withdrawal right is exhausted. The cheaper-leads guarantee continues to apply on its own terms regardless.

9. Earnings disclaimer

GAMADS makes no promises about how much money any user will earn from running ads. The €47 Campaign License fee, the €37 Multi-Offer Toolkit fee, and the €197 Agency Pack fee are subject to the cheaper-leads guarantee mechanic defined in Section 8 and the Refund Policy. All other content on GAMADS surfaces — including testimonials, case studies, blog posts, tutorials, and educational materials — is educational in nature and is not financial, legal, or tax advice.

10. Cancellation and termination

You can close your account at any time from your settings. Closing your account does not automatically trigger a refund; refund eligibility is governed by Section 8 and the Refund Policy.

Either of us can terminate this agreement at any time. GAMADS may suspend or terminate your account if you materially breach these Terms, violate platform safety, or use GAMADS for illegal activity. On termination for cause, the refund mechanic in Section 8 still applies if the underlying purchase remains within its guarantee window and a valid claim is submitted.

11. Limitation of liability

To the maximum extent permitted by law, GAMADS's total liability to you for any claim arising from or related to the service is capped at the total fees you paid to GAMADS in the twelve months preceding the claim. GAMADS is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost advertising spend.

12. Governing law and disputes

These Terms are governed by the laws of the Emirate of Sharjah and the applicable federal laws of the United Arab Emirates. Any dispute you cannot resolve with us informally (we strongly prefer you email first) will be brought before the competent courts of Sharjah, UAE. Nothing in this clause limits your non-waivable consumer rights under the laws of your country of residence, including, where applicable, EU consumer law.

13. Affiliate Program

13.1 Program & Eligibility. Every active GAMADS account holder is automatically enrolled in the Referral Program and assigned a unique referral link in their account dashboard. Use of the link to refer prospective customers, and acceptance of any commission accrued, constitutes acceptance of these Affiliate Terms.

13.2 Commissions & Attribution.Bulzay Solutions FZE pays the referring account holder a commission of twenty-five percent (25%) of the gross amount paid by a referred user for their first GAMADS lifetime licence. Attribution is last-touch: the most recent referral cookie set on a visitor's browser overwrites any prior cookie, persists for thirty (30) days from the link click, and is permanently recorded against the visitor's account upon successful email verification at signup. Commissions accrue in EUR irrespective of the visitor's local currency.

13.3 Approval & Payment.Commissions enter a pending state on accrual and become eligible for approval after fourteen (14) days, during which Bulzay Solutions FZE may reverse, void, or withhold the commission for any reason permitted under these Terms. Approved commissions become payable when an account holder's approved-and-unpaid balance reaches a minimum of fifty Euro (€50). Payment is made manually by Bulzay Solutions FZE on a monthly cadence via PayPal to the email address specified by the account holder. Bulzay Solutions FZE is not responsible for payment-intermediary fees or currency conversion losses imposed by PayPal.

13.4 Refunds & Clawback.Where a referred user's underlying payment is refunded by Bulzay Solutions FZE or charged back through their card issuer, any matching commission then in pending or approved status is automatically reversed (clawed back). Where the matching commission has already been paid out, the equivalent amount becomes a debit on the account holder's affiliate balance and is netted against future commissions; if no future commissions accrue, the account holder remains liable for the debit.

13.5 Prohibited Conduct. The following conduct results in commission forfeiture and may result in account suspension:

• Self-referral, including signing up under one's own referral link with an email address or payment instrument controlled by the referring account.
• Brand-bidding on paid search platforms using "GAMADS" or any confusingly similar variant.
• Misrepresentation of GAMADS, its features, pricing, or guarantees.
• Unsolicited bulk email, comment spam, or any promotion in violation of applicable anti-spam law (including CAN-SPAM, GDPR, and the UAE Cybercrime Law).
• Incentivising clicks via cashback, loyalty points, or other inducements without the referred user's clear understanding that they are clicking a referral link.
• Any use of the affiliate link or commission payout in connection with unlawful activity.

13.6 Tax & VAT. Commissions are paid gross. Each account holder is solely responsible for the declaration and payment of any income tax, VAT, GST, withholding tax, or equivalent charge owed to their tax authority in respect of commissions received. Where the account holder is established in the European Union, the supply of marketing services to Bulzay Solutions FZE (UAE) constitutes a B2B reverse-charge transaction under Article 196 of EU Council Directive 2006/112/EC; the account holder must self-account for VAT in their member state.

13.7 Modification, Suspension & Termination.Bulzay Solutions FZE may modify the commission rate, payout threshold, approval window, or any other Affiliate Term at any time, with thirty (30) days' notice provided in-app or by email. Pending and approved commissions accrued before a change remain governed by the Terms in effect at the time of accrual. Bulzay Solutions FZE may suspend or terminate an account holder's participation in the Affiliate Program at any time for cause, including violation of Section 13.5; in such case, all unpaid pending commissions are forfeited.

13.8 Independent Contractor. Nothing in these Affiliate Terms creates an employment, agency, partnership, or joint-venture relationship between the account holder and Bulzay Solutions FZE. Account holders act as independent contractors and have no authority to bind Bulzay Solutions FZE.

13.9 Governing Law. These Affiliate Terms are governed by the laws of the Emirate of Sharjah, United Arab Emirates, and supplement (do not replace) Section 12 of these Terms.

14. Grandfathered Brand License

A small number of accounts hold one or more active Brand Licenses purchased before the current offer model launched. Each active Brand License continues to remove the GAMADS watermark from image generations associated with one brand workspace on the holder's account, including both past and future generations on that workspace. Brand Licenses are non-transferable, bound to the workspace active at purchase time, and may not be resold. Brand License purchases do not convert into a credit toward the current Campaign License, Multi-Offer Toolkit, or Agency Pack. The Brand License product is no longer sold; no new Brand License purchases are accepted.

For the avoidance of doubt: Sections 6, 7, and 11 of these Terms apply equally to grandfathered Brand License holders.

15. Changes to these Terms

We may revise these Terms as GAMADS evolves. Material changes will be versioned and notified by email or via the app. Continued use after the notice means you accept the revised Terms.
